These Terms & Conditions govern access to and use of TastyPay's website, dashboard, APIs, and payout services. They apply to businesses, agencies, contractors, creator platforms, and any authorized representative acting on their behalf.
Please read these Terms carefully. They contain important information about settlement times, fees, compliance obligations, limitations of liability, and dispute resolution. By using our services you agree to be bound by them.
1. Acceptance of Terms
These Terms & Conditions ("Terms") form a binding agreement between TastyPay ("TastyPay", "we", "us", or "our") and the individual or entity accessing our website, applying for an account, or using our services ("Client", "you", or "your"). By creating an account, submitting an application, or using any part of our services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy.
2. Description of Services
TastyPay provides a payment technology platform that enables businesses, agencies, creator platforms, and contractors to send, receive, and settle payouts across fiat currencies and supported stablecoins through regulated banking and payment partners. Services may include:
- Global mass payout orchestration to beneficiaries in multiple countries.
- Multi-rail settlement via bank transfers, local payment networks, and supported stablecoins.
- Foreign exchange conversion executed through licensed liquidity partners.
- Onboarding, verification, and compliance tooling.
- Reporting, reconciliation, and dashboard access.
TastyPay is a technology provider working alongside regulated financial institutions. The provision of regulated payment, banking, or e-money services is performed by our partners under their own terms and licenses.
3. Eligibility
To use TastyPay, you must:
- Be at least 18 years old and legally capable of entering into a binding contract.
- Be duly incorporated or lawfully operating as a business, and be authorized to act on the entity's behalf.
- Not be located in, established in, or a resident of any jurisdiction subject to comprehensive sanctions imposed by the United States, the European Union, the United Kingdom, or the United Nations.
- Not appear on any applicable sanctions, terrorism financing, or restricted-persons list.
- Not operate a business or activity prohibited by these Terms or by our banking and payment partners.
4. Account Registration
You must provide accurate, current, and complete information during registration and keep it up to date. You are responsible for maintaining the confidentiality of your credentials, for restricting access to your systems, and for all activity that occurs under your account. Notify us immediately at bo@tastypay.co of any suspected unauthorized use.
5. Identity Verification
Before providing services, and periodically thereafter, we perform identity verification and enhanced due diligence, including collection of identification documents, corporate records, source-of-funds evidence, and beneficial ownership information. You agree to cooperate promptly with requests for information and documents. TastyPay may decline, delay, or terminate services if satisfactory verification cannot be completed.
6. Compliance Requirements
You agree to comply at all times with applicable laws and regulations, including anti-money laundering, counter-terrorism financing, sanctions, anti-bribery, tax, consumer protection, data protection, and financial services rules in every jurisdiction relevant to your activity. You will implement your own reasonable controls to ensure funds sent through TastyPay derive from legitimate sources and are paid to legitimate beneficiaries.
7. User Responsibilities
- Provide accurate beneficiary details and confirm the accuracy of payment instructions.
- Ensure you have all necessary rights, consents, and legal bases to share third-party personal data with TastyPay.
- Reconcile settlements, dashboards, and reports promptly and notify us of any discrepancies within thirty (30) days.
- Maintain adequate security, including strong passwords, restricted user access, and secure devices.
- Not use the services to circumvent applicable laws, sanctions, tax obligations, or third-party rights.
8. Prohibited Activities
You may not use TastyPay in connection with:
- Unlawful, fraudulent, deceptive, or abusive activity.
- Money laundering, terrorism financing, sanctions evasion, or tax evasion.
- Trade in weapons, controlled narcotics, human trafficking, or child sexual abuse material.
- Unlicensed financial services, unregistered securities, or pyramid schemes.
- Businesses or transactions prohibited by our banking, card, or payment partners.
- Any activity that may cause reputational or regulatory harm to TastyPay or its partners.
TastyPay may update its restricted list from time to time. Violation may result in immediate suspension, termination, reporting to authorities, and freezing of funds pending investigation.
9. Payment Services
TastyPay facilitates the transmission of value between you and your beneficiaries using regulated partners. When you submit a payout instruction, you authorize TastyPay and its partners to debit the funding source, execute currency conversion where applicable, and credit the designated beneficiary using the agreed rail. Once an instruction has been submitted to a payment rail it may be irreversible.
10. Settlement Times
Settlement times published on our website, in your dashboard, or in commercial materials — including "1 Business Day", "Standard", "Economy", and "Enterprise" — are estimates and not guarantees. Actual settlement time depends on many factors outside TastyPay's control, including:
- Banking partners, correspondent banks, and payment rails involved.
- Destination country, currency, and local cut-off times.
- Compliance, sanctions, and fraud reviews.
- Weekends, public holidays, and bank operating hours.
- Regulatory or jurisdiction-specific requirements.
- Accuracy of beneficiary information provided by you.
TastyPay reserves the right to delay, reject, suspend, or request additional information for any transaction as required to comply with applicable laws, internal risk policies, or partner requirements.
11. Fees
Fees are agreed with each client based on volume, destination, payment rail, and settlement speed. Standard fees typically range between 3.25% and 6.5% of the transaction amount, plus, where applicable, foreign exchange spreads, network fees, and partner charges. All fees will be disclosed to you before you confirm a transaction or in a separate commercial agreement. TastyPay may update fees on reasonable notice.
12. Currency Conversion
Where a payout requires currency conversion, TastyPay or its liquidity partners will apply an exchange rate that includes a margin over the wholesale market rate. Rates are indicative until the conversion is executed and are subject to market volatility. Once a conversion is executed, it cannot be reversed except at the then-prevailing market rate.
13. Stablecoin Transactions
Where you elect to send or receive supported stablecoins, you acknowledge the risks associated with blockchain-based assets, including network congestion, protocol failures, smart-contract vulnerabilities, and the irreversibility of on-chain transactions. Beneficiary wallet addresses must be verified by you before submission; TastyPay is not liable for value sent to incorrect, incompatible, or non-recoverable wallet addresses.
14. Third-Party Banking Partners
Regulated banking and e-money services are provided by TastyPay's partners under their own terms. Your use of underlying accounts, rails, or wallets may be subject to those partners' terms, which will be disclosed where relevant. TastyPay is not itself a bank, does not accept deposits on its own behalf, and does not extend credit unless expressly stated in a separate written agreement.
15. Service Availability
We aim to keep the platform available at all times but do not guarantee uninterrupted access. Services may be affected by maintenance, upgrades, partner outages, or events outside our reasonable control. Scheduled maintenance will, where practicable, be communicated in advance.
16. Intellectual Property
TastyPay retains all rights, title, and interest in and to the platform, including software, dashboards, APIs, documentation, trademarks, logos, and content. You are granted a limited, non-exclusive, non-transferable, revocable license to use the platform solely to receive the services during the term of your agreement. Nothing in these Terms transfers ownership of TastyPay intellectual property to you.
17. Confidentiality
Each party will keep confidential all non-public information disclosed by the other party, use it solely to perform its obligations and exercise its rights under these Terms, and protect it with at least the same degree of care it uses to protect its own confidential information (and no less than a reasonable standard of care). Confidentiality obligations survive termination.
18. Limitation of Liability
To the maximum extent permitted by law, in no event will TastyPay, its affiliates, officers, directors, employees, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, business, goodwill, data, or opportunity, arising out of or in connection with the services. TastyPay's total aggregate liability for direct damages will not exceed the fees paid by you to TastyPay in the twelve (12) months preceding the event giving rise to the claim.
19. Disclaimer of Warranties
The services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation, except where such warranties cannot be excluded under applicable law.
20. Indemnification
You will indemnify, defend, and hold harmless TastyPay and its partners from and against any claims, losses, damages, penalties, and reasonable expenses (including legal fees) arising out of or relating to (a) your breach of these Terms, (b) your violation of applicable law, (c) any transaction submitted by or on behalf of you, or (d) your infringement of the rights of any third party.
21. Suspension or Termination
TastyPay may suspend, restrict, or terminate your account or specific transactions, with or without notice, where required by law, requested by a regulator or partner, or where we reasonably believe there is risk of fraud, financial crime, insolvency, breach of these Terms, or reputational harm. Either party may terminate the relationship for convenience on thirty (30) days' written notice, subject to any longer notice period agreed in a commercial agreement.
22. Regulatory Compliance
TastyPay and its partners operate under financial services licenses, registrations, and regulatory frameworks in the jurisdictions in which they are authorized. We maintain policies for AML, KYC, sanctions, transaction monitoring, record keeping, suspicious activity reporting, and cooperation with competent authorities.
23. AML / KYC Obligations
You acknowledge that TastyPay must satisfy strict AML/KYC obligations and agree to provide any information, documents, or explanations requested to satisfy those obligations. TastyPay may refuse to onboard, off-board, or continue any relationship where these obligations cannot be met. Certain information you provide may be shared with regulators, financial intelligence units, and partners as required by law.
24. Sanctions Compliance
You represent and warrant that you, your beneficial owners, and your beneficiaries are not (i) located in, organized under the laws of, or ordinarily resident in a comprehensively sanctioned jurisdiction, or (ii) named on any list of restricted or prohibited persons maintained by the United States (OFAC), the European Union, the United Kingdom (OFSI), the United Nations, or other applicable authority.
25. Force Majeure
Neither party will be liable for any failure or delay in performance (other than payment obligations) caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, pandemics, government action, sanctions, strikes, banking network outages, blockchain network failures, cyberattacks, or disruption of internet or utility services.
26. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-laws principles. Where mandatory local law grants you additional rights that cannot be waived by contract, those rights are preserved.
27. Dispute Resolution
The parties will attempt in good faith to resolve any dispute through direct discussion. If unresolved within thirty (30) days, the dispute will be finally settled by binding arbitration under the rules of the London Court of International Arbitration (LCIA), seated in London, in the English language, by one or three arbitrators appointed under the rules. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, or to enforce compliance with law.
28. Updates to Terms
TastyPay may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Your continued use of the services after the effective date of an update constitutes acceptance of the updated Terms.
